Who needs a Water Management Plan

Healthcare & senior living

CMS-certified hospitals, critical access hospitals, and long-term care facilities have needed a documented Legionella water management program since 2017. The surveyor memo (QSO-17-30) expired in September 2025, but the requirement flows straight from the infection-control Conditions of Participation — 42 CFR §§482.42, 483.80, and 485.635 — and surveyors still expect to see the program.

New Jersey covered buildings

Under P.L.2024 c.66 (S2188), hospitals, nursing and assisted-living homes, high-rises with centralized water heaters, hotels of 25+ units, correctional facilities, and any building with a cooling tower, spa, pool, fountain, mister, or humidifier must have a written WMP by September 12, 2026 and implement it by December 12, 2026.

NYC cooling towers & everyone with a tower

NYC Local Law 159 of 2025 moved cooling-tower Legionella culture testing to at least every 31 days in season, with test dates reported to the Health Department within 5 days. More broadly, ASHRAE 188-2021 applies to essentially any human-occupied commercial, institutional, or multiunit-residential building with a cooling tower or centralized hot water — single-family homes excepted.

Where this sits against the alternatives

Which buildings need an ASHRAE 188 Water Management Plan?

ANSI/ASHRAE Standard 188-2021 applies to human-occupied commercial, institutional, multiunit residential, and industrial buildings (single-family homes are excluded). On top of the standard, specific mandates cover you: CMS-certified hospitals, critical access hospitals, and long-term care facilities have needed a WMP since 2017 (42 CFR §§482.42, 483.80, 485.635); all covered New Jersey buildings must have one under P.L.2024 c.66 (S2188); and NYC cooling-tower owners face monthly Legionella testing under Local Law 159 of 2025. What's the New Jersey deadline, exactly?

Two dates. Under N.J.S.A. 26:1A-140 (P.L.2024 c.66), covered owners/operators must DEVELOP a written water management program within 24 months of the September 12, 2024 effective date — that's September 12, 2026. They must IMPLEMENT the program within 27 months — December 12, 2026. The plan must exist and be documented before the first date; it must be running before the second. NJ also requires a public-notice posting on the premises and record retention on site for at least 5 years.

What changed for NYC cooling towers in 2026?

Local Law 159 of 2025 (conforming 24 RCNY Chapter 8), effective May 7, 2026, changes Legionella culture testing from every 90 days to at least once every 31 days during the operating season, requires you to report each test date to the Health Department within 5 days, and requires a Maintenance Program & Plan certified annually. Is the CMS Legionella requirement still in effect if the memo expired?

Yes. CMS marked the QSO-17-30 surveyor memo EXPIRED on September 2, 2025, but the underlying requirement never depended on that memo — it flows from the infection-control Conditions of Participation (42 CFR §482.42 for hospitals, §483.80 for long-term care, and §485.635(a)(3)(vi) for critical access hospitals).
